Privacy Notice for Job Applicants

Fuze Health Inc. and its subsidiaries (“we”, “us”, or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Notice explains how we collect, use, disclose, and protect personal information about job applicants and candidates during the recruitment and hiring process.

This Notice applies globally, including where required under:

  • The EU and UK General Data Protection Regulation (GDPR); and

  • U.S. state privacy laws, including the California Consumer Privacy Act (CCPA/CPRA), Colorado Privacy Act (CPA), Virginia Consumer Data Protection Act (VCDPA), and similar laws.

  • Other global privacy laws.

Where you apply for a job opening posted by us, these Privacy Notice provisions will apply to our processing of your personal information.

Where you apply for a job opening via the application function on a job site or similar online service provider (“Partner”), you should note that the relevant Partner may retain your personal data and may also collect data from us in respect of the progress of your application. Any use by the Partner of your data will be in accordance with the Partner’s Privacy Notice.

1. Categories of Personal Information We Collect

Depending on your location and the position applied for, we may collect the following categories of personal data:

  • Identification and contact details: Name, address, phone number, email address, date of birth, national ID/passport number or other forms of government issued ID for the purposes of verifying identity.

  • Employment and education details: CV/resumé, work history, qualifications, certifications, professional memberships, and references.

  • Recruitment information: Interview notes, assessment results, background checks (where permitted by law), and correspondence.

  • Demographic or sensitive data (special category data under GDPR): Information such as gender, race/ethnicity, disability status, or veteran status — only where voluntarily provided or required by law for equal opportunity monitoring or legal compliance.

  • Technical data: Information collected via our recruitment platforms (e.g., log data, cookies, IP address) to maintain system security and improve recruitment processes.

2. Sources of Personal Information

We may collect your personal information directly from you, from recruitment agencies, professional networking sites (e.g., LinkedIn), public databases, background check providers, or references you provide.

3. Purposes and Legal Bases for Processing

We use your personal information for the following purposes:

4. Disclosures of Personal Information

We may share your information with:

  • Fuze Health subsidiaries where required to process your application.

  • Internal teams involved in recruitment and HR management.

  • Third-party service providers (e.g., recruitment platforms, background check providers, IT support).

  • Legal, regulatory, or governmental authorities as required by law.

  • Affiliates or subsidiaries within our corporate group for centralized HR functions.

We require all third parties to respect the security of your personal information and process it in accordance with applicable data protection laws.

5. International Transfers

As a global organization, your personal data may be transferred to countries outside your own, including to or from the United States, and to or from other jurisdictions that may not provide the same level of protection as your own.

Where required, we use appropriate safeguards such as:

  • EU Standard Contractual Clauses (SCCs);

  • UK International Data Transfer Addendum; or

  • Other lawful transfer mechanisms.

6. Data Retention

We retain personal information for as long as necessary to complete the recruitment process and to comply with legal or record-keeping obligations.

If you are not hired, we may retain your information for a minimum of 60 months for future opportunities unless you request deletion sooner.

7. Your Privacy Rights

Regardless of whether you have particular rights in your jurisdiction of residence, we will do our best to honor all reasonable requests and questions related to your data privacy. You may have the following rights, depending on your jurisdiction of residence:

  • Right to know the categories of personal information collected and disclosed, and the sources of these.

  • Right to know the business or commercial purpose of collecting or sharing the personal information.

  • Right to know the categories of third party to whom personal information was shared.

  • Right to access your personal information and right to obtain a portable format or machine readable copy of your personal information for transportation to another organization.

  • Right to deletion of your personal information (subject to exceptions).

  • Right to correct and rectify inaccurate personal information.

  • Right to opt out of sale or sharing of personal information (we do not sell applicant data, and we do not sell or share applicant data as those terms are defined under California Consumer Privacy Act).

  • Right to limit use and disclosure of personal information to what is necessary for the recruitment process.

  • Right to object or opt out of certain processing activities, such as where profiling or automated decision making may be involved, or where we rely on our legitimate business interests for an activity. Please note that certain types of opt out may mean you may not be able to complete your application or may prevent us from processing your application.

  • Right to obtain information about Automated Decision Making - you may request meaningful information about the logic involved in any automated decision making or profiling related to your application, object to such processing or have a human review.

  • Right to withdraw any consents given - although where we have already taken an action based on a consent you have provided prior to withdrawal of such consent, any data processing or action taken under that consent may not be able to be reversed, erased or similar. 

  • Right to non-discrimination for exercising your privacy rights.

  • Right to lodge a complaint with a supervisory authority.

8. Security

We implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure.

9. Automated Decision-Making and AI

We do not use automated decision-making or profiling that produces legal or similarly significant effects in our recruitment process. We may use Artificial Intelligence for the purposes of helping determine suitability of resumes (for example highlighting resumes with experiences or key words that match the job requirements) but this is not used in any way that rejects or accepts an application - such decisions always require a human review.
